In which Para is Surah Fatihah?

A questioner once asked: "Which para is Surah Fatihah part of? Sometimes it is written in `Amma para (30th para) and sometimes in the Alif laam meem para (1st para)?"

Hadrat Mufti Sahib replied: "In which hadith is it clearly mentioned that this is the first, second or third para? Is there any mention of different paras in the hadith?
Questioner: "No. There is no mention of it in the ahadith."

Mufti Sahib: "Why then are you asking about a portion of a para when there is no explicit mention of the paras? If you have to ask anyone, then ask Jalaalud Deen Mahalli as to where did he place Surah Fatihah in Jalalain."

Questioner: "It is said that he started his tafseer from Surah Kahf and on completing the thirtieth para he started with Surah Fatihah in order to complete the remaining fifteen paras. However, he passed away before accomplishing his desire and was only able to complete the tafseer of Surah Fatihah. That is why people have placed his tafseer of Surah Fatihah at the end together with the tafseer of the last para."

Mufti Sahib: Those who came later mentioned this. Ask Jalalud-Deen Mahalli as well. Jalalud-Deen Suyooti رحمة الله عليه who was a high-ranking mufassir (commentator) had accomplished the completion of the tafseer. Jalalud-Deen Mahalli had written the tafseer from Surah Kahf upto Surah Nas and thereafter Surah Fatiha. However he then passed away. Jalalud-Deen Suyooti then compiled the tafseer of the first half of the Qur'an (i.e. from Surah Fatiha upto Surah Kahf) in such a manner that it is difficult to notice that this is a tafseer written by two mufassireen. This Tafseer-e-Jalalain is part of the Dars-e-Nizami syllabus (the syllabus used in the Darul Ulooms) and holds an important position.

As for in which para Surah Fatihah appears, then in an answer to a question the following is mentioned in Ahsanul-Fatawa:

Surah Fatihah is like a matn (primer text) and the remainder of the Qur'an is like its commentary. Hence, neither is Surah Fatihah excluded from the Qur'an nor part of any specific para. Instead, it is incorporated in all the different parts of the Qur'an.

Dividing the Qur'an into paras has not been established from Nabi sallallahu alayhi wasallam nor from Hadhrat Uthman r.a. Rather, for the sake of convenience the Qur'an was coincidentally divided into thirty paras when the different masahif (copies of the Qur'an) were being transcribed. Thus it is possible for a part of the Qur'an to remain outside these thirty paras since the Qur'an is not restricted to only what is within these thirty paras.(Ahsanul Fataawa v1p486)
